Criminal Sentencing

This research project examines dementia as a factor in sentencing. It will consist of two papers. The first paper will analyse the brain disorder as an aggravating factor. The second paper will examine it as a mitigating factor.
 
The aim of the project is to shed light on how judges are responding to dementia among victims and offenders when determining a fit sentence. Crown and defence counsel may find the analysis useful during plea bargaining or when formulating a sentencing position.
